1 判断申请人所属的组织性质 这一点在实际操作中争议不大，在此就不做赘述了。 2 判断申请人与Dang组织的紧密程度 对于是否是Dang员的问题，通常申请人会被要求在移民签证申请表或者I485表格中做如实披露。即使申请人不是正式Dang员，但如果其为Dang主导的机构工作的（比如公务员），也可能被认为是与Dang有紧密关联的人。 3 申请人参与Dang活动的决定是否是重大的“meaningful” 此条往往是Dang员能否申请绿卡的关键。如果加入Dang是申请人故意的“intentional”行为，那么将会被认定为构成重大的“meaningful”法律要件而无法申请绿卡。这一条要求来自于最高法院的一则判例：“如果要判定一个人是在清醒状态下自愿加入Dang组织，必须有实质性的证据作为支持”。在实际操作中，如果有证据表明申请人对Dang的政治性质是有明确认知的，那么美国移民局或者美领馆就可以认定为构成重大的“meaningful”法律要件而拒绝绿卡申请。申请人一般可以通过提交声明的方式，详细解释自己加入Dang的初衷以及在Dang组织内的工作内容以帮助证明自己不满足此要件。 4 申请人是否满足例外情形 即使申请人被判定为满足前三个条件，但只要其满足以下法律规定的例外情形，还是可以申请绿卡。 （1）     加入Dang组织不是自愿行为 （2）    Dang员身份在移民申请前5年已经终止      此外，美国移民法针对因Dang员身份无法获得绿卡的申请还提供了豁免的渠道，如果申请人是美国公民的父母、配偶、子女、兄弟姐妹，或者是美国绿卡持有人的配偶、子女，只要证明自己不会对美国国家造成威胁，就可以申请豁免依然拿到绿卡。
