这不是完全的事实吧，那个男生是游泳运动员，奥运会苗子，一开始斯坦福也不打算开除他，法官判6个月，执行三个月，还有三个月probation。判决后女孩发公开信，把事情闹大，才有一百多万人联名要求罢免法官后面的事情。

歪楼单纯从 defensive driving 的角度，我觉得父母要给娃创造家的感觉，即使成绩差一点。
不论何种原因推娃，经常让娃哭不是一个好的教育方式。

这个全靠女孩文笔好，写了非常感人的victim statement, 当庭宣读非常震撼。当时法庭上的记者就说是史上最强victim statement. 这个女的刚写了书，know my name, 非常了不起，可以说是metoo的鼻祖。 本来这个应该拯救更多楼主贴的这种Case, 可惜被民主党挟持，去搞了卡瓦脑大法官以后就变味了。

我发现，这个世界上，不是好人有好报，恶人有恶报，而只有强者才能生存。我一个初中同学，因为长得不好看，初中三年长期被差不多全班男女生孤立排挤讥笑欺负，我不知道她是不是在背后偷偷哭，但在人前一直很淡定，从来没有因此崩溃。现在她事业挺成功的。

别扯这么多，她只要当时不愿意就是强奸。她是不是正经女孩和是不是强奸毛关系都没有。
从 legislative 的角度，只要当事人当时没有同意，就构成强奸。
但从 judicial 的角度，刑事的难度在于 beyond reasonable doubt 证明当时没有同意。因为刑事为了尽量避免造成窦娥，举证和 prove beyond reasonable doubt 的责任在检方。
从 policy making 的角度，这样虽然不能保证保护所有的女性，但折中衡平常常是 policy making 的现实可达到目标。而现实的说，这种 policy making 折中，加上个人（也包括男生）好比 defensive driving 的防范意识，还是能够保护大部分 defensive driving 的女生和男生。（男生也是要避免成为窦娥的概率的，毕竟陪审团不是自己后院）。
