This is definitely the case where the custodial parent (the parent with whom the child primarily resides) requests an increase in support from the parent with the new child. And, it also seems to be gaining acceptance as an element in cases in which a new parent, who is paying child support for children from a prior relationship, requests a reduction in that support. There is a provision in the CSSA that appears to endorse this trend. Under certain circumstances, a judge may decide that a parent’s share of child support under the guidelines is unjust or inappropriate. In making that decision, the judge can consider that parent’s new children's needs, which will probably weigh in favor of reducing child support. If you want to use the above-referenced “unjust or inappropriate” provision of the CSSA to reduce child support, you should know that the judge will not only look at your income, but your new spouse’s income as well. 补充一下,前妻有工作的,但是收入比他少很多。
娃小时daycare是贵点,也就是加州纽约这种地方贵,俺们大农村一个月800-1000足够,而且也就几年,5岁就上学了。为什么老想着老公挣的多,华人上女的挣的比老公多的不少吧,离婚了还怕老公找我要赡养费呢。
至于summer camp,有多少钱办多少事,我这边一个星期200刀的也挺好,非要去高大上的几千一周的summer camp么?
离婚对生活质量有影响是肯定的,但是相比两人同一屋檐下互相折磨,离婚并不是多么悲惨的生活。
大学学费肯定是有影响,这个是大头,这个可以离婚协议谈妥,实在不行自己付点,孩子长大拿奖学金或者贷款,也没啥。(其实楼里举了这么多例子,狠心不管不顾的爸爸还是极少数)
也别以为自己是孩子拖累了,问问自己,不生孩子不照顾孩子,你能不能挣30w?
把这点想明白,自己挣的是自己的,孩子是自己的,老公分担抚养费,这些才是自己碗里的。至于老公那30万,是人家锅里的,以前因为一纸婚书可以吃人家锅里的,千万别吃多就以为是自己锅里的。
孩子的监护权有两种:physical custody and legal custody
一般legal custody是shared, 但是physical custody则不一定,可以是share, 比如双方轮流带孩子每人一周。也可以一方有primary physical custody, 另一方有visitation rights. 楼主只说到了母亲有primary physical custody, 父亲visitaion这一种情况。事实上也可能父亲有primary physical custody, 即主要住在父亲那里,而母亲有visitation schedule. 也可能是shared physical custody父母双方每人一半时间。
还有,抚养费没有封顶这一说。抚养费的一个宗旨是,父母离婚后,要保障孩子的生活质量没有急剧下降,诉求是最大可能持平。抚养费的计算有严格的软件控制,当然软件算出来的还要court stamp才行,所以中间可以有协商协调。比如男方收入高很多,但是财产分割已经给了女方一个超过计算的数目了,court考虑到靠这些超过的钱,孩子的生活应该有了一定的保障,那就会适当放松抚养费。抚养费算法只有三个parameter input:父亲收入,母亲收入,以及父母看孩子的时间比例。所以要说父母哪一方给了抚养费就一贫如洗那也是不可能的,因为他/她可以要求多看孩子,这样抚养费就大大降低了。

关键是华人妈妈一般工资不低, 拿不到2000刀。一般就拿个几百刀, 几百刀其实真的非常少。 买衣服 各种开销基本都是妈妈付。
至于爸爸挣不到10w, 一个孩子几百刀,两个孩子一千多,男的自己一个月税后也就5000,付完抚养费只剩3000多,生活也不容易,估计男的也不敢轻易离婚

抚养费是根据爸爸妈妈工资决定的, 要是两人都6万 时间平分 那一毛钱都没有。 如果老公10万 妈妈6万 也就几百刀了。 即使妈妈带2/3的时间,娃如果再上day care 这几百块就够一半的day care 剩下吃饭 添置各种家具 衣服 用具 全部要妈妈掏钱。 妈妈收入6万的话 税后再放点HSA和401也就3000刀吧 加上抚养费算800 也才3800, 要付day care 房子, 水电气, 各种食物, 车子,保险 汽油 衣服鞋子。 很紧张的。
为什么时间平分的,大家默认全部钱都是妈妈出?

爸爸出了一半的daycare啊,大家可能是假设妈妈会出的多一些。而且这种出轨的爸爸,会花很多钱在孩子身上?就像前边说的,基本生活能保证,其他的就看两方各自的良心了 - 问题是渣男的良心肯定是很有限的。而且妈妈的工资低的话,生活质量还是会受很多影响的。
孩子的基本生活保障了,锦上添花的东西,兴趣班少上几个,summer camp别去那么高大上的,我不觉得对孩子的前途有啥影响。
唯一影响的是学区房,这个也不是不能解决的,换小一点的(以前4个人住,现在3个人住),或者干脆搬到美国除加州纽约任意一个州。
一般孩子爸爸不同意的话,不能跨洲搬家的。
难道亲生爸爸一定要把孩子逼上绝路?已经不用他带了

前妻好像也不错,也又生了孩子。有没有后悔不知道了,但是经济上肯定不亏。前不久好像也把父母名下的房产给女儿了。

不管婚姻靠得住还是靠不住,女人都应该保持经济独立和精神独立。

但是如果女方挣 15w/year ,男方挣 35w/year ,(比方说最近的帖,爸爸重男轻女 太小气 , 开很低的暖气 , 不给两女儿上兴趣班的例子 。 15w / 35w 是那位楼主mm 自己写的薪资收入。) 他们结婚十年以上, 那位妈妈如果离婚了, 应该能拿到$3,500/month spousal support 。 加州的spousal support 一般是十年以上可以拿, 可拿年数是婚年/2, 也就是妈妈可以拿至少五年的spousal support, 这笔费用再加上孩子到成年的child support, 再加上所有现产与投资房一半一半 , 总觉得那位妈妈和女儿会过得比现在的生活品质好。 所以请问楼主mm即使双方都有工作, 女方工资不错, 但是不是还是看个别情况 ?
多谢更新。原来在国内,也算是对自己的保护,不过对男的来说当时确实狠了点。
当然实际上的child support是可以超过2000的,但是只有这个2000才是法律规定的,超过的部分都是法官酌情判。做爸爸的当然也可以自愿多给些。
如果孩子们都已经工作过了18岁, 再离婚就没有这些费用了吧, 会离婚的就等孩子们成年后吧

每州不一样,还是建议去找专门家事法律师谘询。 很多律师提供免费头一小时的谘询, 就算一些很牛的律师, 第一个小时也按錶收费, 我认为花个几百元了解详情, 也绝对值得。 (另外 许多公司也提供员工免费的律师谘询,这也是很好的另一个可用资源。)

考虑到一般来说前妻的小孩会比后妻的大一些 越大分到的越少。。。综合考虑肯定是不合算的。。。。换句话说除非你真的就打算不工作不重婚一直吃前夫的。。。否则没啥benefit的 不可能那么爽

单妈找了政府工 这样账面收入少 多拿点child support 退休福利好 给自己多攒点。。。
女人离婚 只要把孩子留给自己 男人这辈子就算完了 你继续花他的钱过日子 还可以找男朋友。
前妻挣170k,4000只是child support。我觉得还是很多的。
