在服刑期间，因为被认为极具危险性，他戴着脚镣并有专门的人员盯着。每次他被运送 到法庭的时候，都有7辆全副武装的汽车押送。令人震惊的是，他居然在监狱中将36名 囚徒极端化，使得监狱方面不得不将他独立囚禁。
据Civil Rights微信了解，在起诉Robertson的时候，检方努力寻求以恐怖主义起诉他 。虽然检方通过外国情报调查法案要求对他增加10年的刑求，无奈美国地区法官 Gregory Presnell认为证据不够充分而在2015年6月释放了Robertson。
Robertson否认他参与了恐怖活动。但联邦执法人员早在1991年就很熟悉Robertson。作 为海军陆战队的前成员，他曾经以“阿里巴巴”为名，领导纽约臭名昭著的犯罪团伙“ 阿里巴巴和四十大盗”，抢劫了超过10家银行和一些家庭以及邮局，杀害了3名警察， 并攻击了一位警察。与其同时，联邦权威机构表示Robertson曾担任Omar Abdel Rahman (Blind Sheik)这个参与911的组织的保镖，他还窃取了超过30万美元并捐给他所在的清 真寺。不过，对这些指控，Robertson一概否认。
Robertson在911被抓之后，他和检方达成了合作协议，帮助FBI在2004年到2007年一起 纪录恐怖分子的计划以及他们在非洲、埃及和美国的网络，只被判了4年监禁。
不过，他的律师坚决否认各种指控，并认为他并没有教唆他的客户们任何需要被谴责的 暴力。律师认为Robertson已经得到的惩罚恰恰就是他已经犯的罪，别无其他。
Robertson的学校并非枪手唯一的精神寄托地。在大屠杀发生前两天，他还在Fort Pierce（他的居住地）的伊斯兰中心呆过。该中心曾经是一位于2014年在叙利亚自爆的 另一个美国出生的人体炸弹Monar abu Salha经常到访之地。这两位早已结识。所以在 2014年的时候，枪手已经被FBI调查过，可惜当时执法部门认为两人的交流比较有限， 从而放弃了指控。
