据《CNN》报导，美国司法部指出，宪法第二条规定总统拥有下令使用军事力量和维护国家利益的权力，而且轰炸伊朗3处核设施的做法，并不构成宪法第一条裡需要国会同意的程度。
司法部表示，川普的决定得到众议院和参议院的支持，因此白宫认为这个做法完全有法律依据，并且符合司法部法律顾问办公室（DOJ’s Office of Legal Counsel，为总统、政府各单位提供谘询服务）先前在两党监督下所撰写的备忘录。
不过，由于美国宪法第一条规定国会才有宣战权，因此司法部强调若之后和伊朗演变为长期衝突，最终还是需要国会批准。
