据《CNN》报导,美国司法部指出,宪法第二条规定总统拥有下令使用军事力量和维护国家利益的权力,而且轰炸伊朗3处核设施的做法,并不构成宪法第一条裡需要国会同意的程度。
司法部表示,川普的决定得到众议院和参议院的支持,因此白宫认为这个做法完全有法律依据,并且符合司法部法律顾问办公室(DOJ’s Office of Legal Counsel,为总统、政府各单位提供谘询服务)先前在两党监督下所撰写的备忘录。
不过,由于美国宪法第一条规定国会才有宣战权,因此司法部强调若之后和伊朗演变为长期衝突,最终还是需要国会批准。
