This could be an interesting case for the law school text book. What would happen if the residents do not buy back the street? The residents are sitting on their single house private lands where there is no trespassing concerns for them to access their properties from a city owned street unless this couple build up gates to limit the access of general public. It's a good case to follow up.

1, this is a private road
2. the association failed to pay the tax
3. it was sold to pay for the tax lien.
4. you can charge for the parking. You can not charge for the road usage.
5. The main lawsuit will be with the city. They are just the co-defendants.
6. Nothing wrong with this transaction. If they did not buy, someone else would bought this road. Do you know that this was a white only property before? It is really an irony.

刚从佛罗里达州度假回来的郑宇翔,心情一点也不轻松。摆在他面前的,是9月5日旧金山市议会的公听会、一场官司,和无数媒体的采访询问,“但是至少我心态是积极的,看到很多人支持我们,大家都觉得我们没有错。”郑宇翔表示。
引发争议的就是他太太林晓欣(Hiuyan Lam,音译)名下的一条街道。这条久负盛名的普利西迪欧街(Presidio Terrace),两年前被这对华裔夫妇用9万元买下,所有者写的是林晓欣。今年7月,普利西迪欧屋主协会(Presidio Homeowners Association)提起诉讼,将林晓欣和旧金山市府告上法庭,要求拿回这条街的所有权。在诉讼的文书当中,屋主协会称大约自1905年起,该协会就拥有和管理著这片区域。据旧金山纪事报的报导,这已经是第二次该街道易主了,40年前该街产权曾被转到州政府名下。
同时该协会的律师代表还上书至旧金山市议会,要求市议会举办公听会,并撤销拍卖结果。屋主协会的律师代表安柏利居(Scott Emblidge)7月11日给市议会发信,言辞犀利,直接认为该拍卖不合法,无法理解为何有人会买下一条街的公共区域,猜测是林小姐想让屋主们从她手上“买回来”。
“他们的律师挺激进的”,郑宇翔向记者坦白,“但是我们和原先的立场一样,还是希望拥有这条街,并不会想要卖回去”。
被问及有否联络过屋主协会,郑表示还没有:“我持开放态度,可以对话”。此外,对该街道的发展计画,郑表示目前还没有进展:“我现在要做好的就是准备好9月5日的听证会。”
